NOTICES, TERMS AND CONDITIONS

We are a travel agent and we look forward to the opportunity to act as your booking agent for your travel needs. These terms and conditions (the “Agreement”) describe what you are legally entitled to expect from us when you purchase travel-related services through us, as well as your obligations as a customer. The terms “we”, “us” and “our” refer to the Travel Agent. The term “you” refers to any customer visiting our website, booking a reservation through us, or otherwise using our services.

Our Agreement With You

Products and Suppliers

We sell a variety of travel-related products from different suppliers and service providers (“Suppliers”). Each Supplier has its own terms and conditions applicable to your particular arrangements, in addition to our general terms and conditions, and you should ensure that you understand them. Certain software and content found on our website are owned by, or licensed to, us or our Suppliers, and your use of such software and content may be subject to additional conditions. Our websites, which are referred to throughout this Agreement, can be found at www.sondersandbeach.com and www.quiiky.com.

The Travel Agent acts as an intermediary or “Booking Agent” for products and services that are not directly supplied by us (e.g., air carriage, ground transportation, hotel accommodations, meals, tours, cruises, etc.). We are not a co-vendor of such products and services. You will enter into a separate contract with the relevant Suppliers in connection with those products and services.

All airline tickets are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may apply due to additional costs imposed by a Supplier or government authority. You may be charged additional sums by the Travel Agent to offset increased fees, fuel surcharges, taxes, and fluctuations in foreign exchange markets, or any combination thereof. By accepting these terms and conditions, you consent to any such post-purchase price increases and authorize Sonders and Beach Italy Srl to charge your credit card for such additional amounts.

Deposits and Payment

Any deposits paid by you are non-refundable and non-transferable. In certain limited circumstances, and at Quiiky’s sole discretion, Quiiky may allow a deposit to be transferred to another Quiiky trip, provided that the cancellation occurs more than 60 days prior to departure. Any such exception is granted solely at Quiiky’s discretion and does not create any obligation for future cases.

Payment of a deposit enables us to hold a reservation for you but does not guarantee the price. The price can only be guaranteed once we receive full payment and the relevant travel documents have been issued, subject to any terms and conditions of the Supplier. We will advise you of the date by which full payment is required. By providing your payment information, you authorize us to make the necessary payment arrangements with the corresponding Suppliers.

We reserve the right to refuse personal checks as a method of payment. After full payment, the terms and conditions of your contract with a Supplier may permit the Supplier to increase the cost of your arrangements. If we are acting as your Booking Agent, we will pass on any such increase to you as soon as we become aware of it. Where we have arranged a package, changes in transportation costs (including fuel costs), taxes, fees, and exchange rates may result in changes to the price of your travel arrangements after you have paid in full.

Documentation

Our general practice is to provide travel documents to our customers electronically whenever possible. We reserve the right to charge an administrative fee if you request that such documents be issued and sent in hard copy format.

Cancellations and Changes

Your contract with your Suppliers may allow them to cancel or amend bookings. If we are acting as your Booking Agent, we will use reasonable efforts to ensure that you are promptly notified of any significant changes once we become aware of such changes and, where possible, before your departure. However, we accept no liability for any changes made by Suppliers or for any costs incurred as a result of such changes. Subject to the Supplier’s terms and conditions, you will then have the choice of accepting the amended arrangements, accepting an offer of alternative travel arrangements (if made available by the Supplier), or canceling your booked arrangements and receiving any applicable refunds. We do not guarantee that any refund will be available.

If you have booked a flight and we are notified by your airline of a significant schedule change before you leave your country of departure, we will contact you by email to advise you accordingly. Please ensure that you have provided us with a valid email address and that you regularly check for messages prior to travel. We have no control over airline schedule changes and accept no liability for any costs that may arise as a result of such changes.

After you have left your country, it is your responsibility to check with the airline that any onward or connecting flights are operating as booked. We strongly recommend that you contact your airline at least 72 hours before the scheduled departure of each flight to confirm this. Please note that for some airlines it may be mandatory to reconfirm your intention to fly.

Your Agreement With Us

Your Acceptance of these Terms and Conditions

By booking travel arrangements with us or using our website, you agree to be bound by the terms of this Agreement, including Parts 1–3 of this Agreement, as well as any additional terms and conditions of any Supplier that are applicable to your booking, travel arrangements, or use of any website content. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due. You acknowledge that any violation of these terms and conditions may result in: (a) the cancellation of your reservation or purchase; (b) the forfeiture of any money paid for your reservation or purchase; (c) denial of access to the applicable travel-related product or service; and (d) our right to debit your account for any costs we incur as a result of such violation.

You represent and warrant that: (a) you are of sufficient age to use our services and website and to create legally binding obligations in connection with such use; (b) you are legally authorized to act on behalf of those you represent and to accept these terms and conditions on their behalf; and (c) all information supplied by you (or by members of your group) is true and correct. You are responsible for informing all other persons in your party of the terms and conditions applicable to their travel arrangements. You understand and agree that you are financially responsible for any use of our services or website by you or by any person using your name or account.

Deposits and Payment Schedules

Daily Excursions & Flights

  • Full payment (100% of the total price) is required in advance.

Tour Services & Packages

  • Deposit: at least 25% of the package price, due upon confirmation of the reservation.
  • Final Payment: the remaining balance (75% of the package price) is due 90 days prior to departure.

If paying by credit card, the second deposit and/or final payment will be charged to the same credit card used for the first deposit, unless Quiiky is notified in writing of any changes at least seven (7) days prior to the applicable payment due date.

Quality Guarantee

Quiiky offers high-quality accommodations, tours, transportation, and services. We reserve the right to make changes to any accommodation, tour, transportation, or service included in our itineraries. However, if Quiiky needs to substitute any accommodation, tour, transportation, or service, we will use reasonable efforts to provide a comparable alternative in terms of timing, price, and quality.

Rate Guarantee

Tour prices are guaranteed once Quiiky receives your initial deposit. However, in the unlikely event of a substantial increase in operating costs, fuel costs, tariffs, or taxes prior to departure, we reserve the right to apply a surcharge not to exceed 3% of the land cost per person. All assessed government or quasi-government fees and taxes are subject to change without notice at any time, and we reserve the right to apply a surcharge for such fees and taxes whether you have made a confirmed booking under deposit or have paid in full.

Cancellation Policy

If you cancel your reservation or re-book to a different trip, any refund of the total package price will be subject to a cancellation charge in accordance with the following schedule:

  • Cancellations more than 120 days prior to the start of the trip: 10%
  • Cancellations 91–120 days prior to the start of the trip: 25%
  • Cancellations 61–90 days prior to the start of the trip: 50%
  • Cancellations 0–60 days prior to the start of the trip: 100%

Where different terms are specified in a specific offer, the above cancellation policy shall not apply.

Travel insurance is optional; however, we strongly recommend purchasing comprehensive travel insurance, which may include coverage for trip cancellation, baggage delay, and other unforeseen events. Travel insurance may be purchased through us.

If You Change Your Booking

Where a change to your travel arrangements is requested by you and such change is permitted and possible, our standard service fees will apply in addition to any Supplier charges. Please note that all reservation changes are subject to availability and to the terms and conditions of the relevant product purchased.

Changes to name details are not permitted by many airlines and other Suppliers. While we will endeavor to assist where possible, please note that most airlines and Suppliers treat a name change as a cancellation, to which standard terms, conditions, and charges would apply.

Flights must be taken in the sequence in which they appear on your ticket or e-ticket confirmation. If you intend not to take any flight segment as booked, you must contact the airline as far in advance as possible to discuss your options. If you do not check in on time for a confirmed reservation, the airline may register you as a “no-show”, which could result in extra charges and/or the cancellation of your entire flight itinerary and/or the invalidation of your ticket.

Quiiky packages may be transferred to another guest for a €150 service fee; however, transfers cannot be accepted within seven (7) days of departure.

If You Cancel Your Booking

If you cancel your arrangements, you may be entitled to a partial refund. In addition to the cancellation terms and conditions of your Supplier(s), our standard fees will apply as outlined in your receipt or booking confirmation. We must receive your original voucher before any applicable refund can be considered. If you cancel your arrangements prior to the balance due date, any deposits paid remain non-refundable.

Refunds will only be made once we have received the corresponding funds back from the Supplier(s). Generally, flight tickets cannot be refunded if they have been partially used. We are not responsible for any failure by a Supplier to pay a refund.

If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer.

Important Notice Regarding Airline Reservations

If you arrive at an airline ticket counter or passenger check-in counter with your confirmed ticket and the airline indicates that no reservation exists, do not leave the counter. Check your ticket carefully. If the status box shows “OK” for the flight in question, airline policies typically require the airline to accommodate you on that flight; if this is not possible, the airline must either find you an alternative flight or provide denied boarding compensation, in accordance with applicable rules. If necessary, ask to speak with a supervisor.

If You Have A Complaint

If you experience a problem during your holiday, you must inform the relevant Supplier (e.g., your hotel) immediately. If the Supplier is unable to resolve the matter, please contact us without delay. If you fail to contact us in a timely manner, we may not be given the opportunity to investigate your complaint and attempt to rectify any issue while you are away, and this may affect your rights under this Agreement.

Travel Documents and Destinations

It is your responsibility to ensure that all details on your travel documents are correct and to notify us immediately of any errors or discrepancies. Your travel documents are valuable and should be safeguarded as if they were cash. Please note that it may not always be possible to replace travel documents in the event of loss, theft, damage, or similar circumstances.

Prior to booking international travel, we recommend that you review any government prohibitions, warnings, and travel advisories applicable to your destinations. By offering travel to any particular destination, we do not represent or warrant that travel to such destination is safe or without risk.

Passport, Visa and Immigration Requirements

While Quiiky will assist where possible, passport, visa, vaccination, and entry requirements vary by country and remain solely the responsibility of the traveler. Generally, your passport must have at least two blank pages and should be valid for at least six (6) months beyond your planned departure from the country you are visiting. Passport and visa requirements may change at any time, and travelers should always verify the most current country-specific requirements prior to travel.

It is your responsibility to comply with all passport, visa, and other immigration requirements applicable to your itinerary. You should confirm such requirements directly with the relevant embassies and/or consulates. We accept no responsibility if you are unable to travel as a result of your failure to comply with any such requirements.

You are also required to carry a valid International Student ID, International Youth ID, or International Teacher ID card if you are traveling on a special student/youth/teacher fare. It is your responsibility to verify eligibility and documentation requirements with the travel expert assisting you.

Travel Insurance

Travel insurance is an important element of your travel arrangements. We strongly recommend that you obtain adequate insurance coverage for the duration of your journey. Travel insurance may be mandatory for certain travel arrangements. Where available, we may assist in arranging travel insurance, provide you with a quote, and respond to any queries you may have regarding coverage.

Validity

All prices quoted are in Euro (€). Should any government charges change between the date of quotation and the time of travel, we reserve the right to adjust the package price accordingly. All prices remain subject to change until your deposit is received and your reservation is confirmed by Quiiky.

Use of Our Services and Website

You agree that you will use our website and services only to make legitimate reservations or purchases and that you will not make speculative, false, or fraudulent reservations, including reservations made in anticipation of demand. You agree to use our website and services only in compliance with applicable laws and regulations.

Without our prior written permission, you may not: (a) access, monitor, or copy any content or information on our website using any “robot”, “spider”, or other automated or manual device or program; (b) deep link to any portion of our website; or (c) “frame” or otherwise incorporate any portion of our website into any other website.

Our website may contain links to third-party websites, which are provided solely for your convenience. You should take precautions to ensure that any links you access are free of viruses, worms, Trojan horses, or other destructive mechanisms. The inclusion of such links does not imply that we endorse any third-party website or any content contained therein. We are not responsible for the content of third-party websites or for the data privacy practices of such websites.

Indemnification

You agree to indemnify and hold harmless us and our affiliates, and any of our Suppliers, and any such parties’ officers, directors, employees, and agents, from and against any and all claims, causes of action, demands, losses, damages, liabilities, and other costs and expenses (including reasonable legal and accounting fees) brought by you or any third party as a result of: (a) your breach of this Agreement; (b) your violation of any law or the rights of any third party; or (c) your use of our website.

Privacy Policy

You consent to our processing and sharing of personal information relating to you and other members of your party that you have provided to us, in accordance with the terms of, and for the purposes set forth in, our privacy policy. You represent that you have read and agree to the terms of our privacy policy, which is available on our website.

Additional Terms

Warranties, Disclaimers and Limitation of Liability

FOR THE AVOIDANCE OF DOUBT, REFERENCES HEREIN TO “US”, “WE” AND “OUR” SHALL ALSO REFER TO OUR AFFILIATES. THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES PROVIDED BY US OR OUR SUPPLIERS, OR PUBLISHED ON OUR WEBSITE, MAY INCLUDE INACCURACIES OR ERRORS, INCLUDING PRICING ERRORS. WE DO NOT GUARANTEE THE ACCURACY OF, AND DISCLAIM ALL LIABILITY FOR, ANY ERRORS OR OTHER INACCURACIES RELATING TO SUCH INFORMATION THAT APPEARS ON OUR WEBSITE. WE EXPRESSLY RESERVE THE RIGHT TO CORRECT ANY PRICING ERRORS ON OUR WEBSITE AND/OR ON PENDING RESERVATIONS MADE UNDER AN INCORRECT PRICE. IN SUCH EVENT, IF AVAILABLE, WE WILL OFFER YOU THE OPPORTUNITY TO KEEP YOUR PENDING RESERVATION AT THE CORRECT PRICE, OR WE WILL CANCEL YOUR RESERVATION WITHOUT PENALTY.

ANY RATINGS FOR SUPPLIERS ARE INTENDED ONLY AS GENERAL GUIDELINES, AND WE DO NOT GUARANTEE THE ACCURACY OF SUCH RATINGS. WE MAKE NO GUARANTEES REGARDING THE AVAILABILITY OF SPECIFIC PRODUCTS AND SERVICES. WE MAKE NO REPRESENTATIONS REGARDING THE SUITABILITY OF THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES PROVIDED BY US OR CONTAINED ON OUR WEBSITE FOR ANY PURPOSE. THE INCLUSION OR OFFERING OF ANY PRODUCTS OR SERVICES BY US DOES NOT CONSTITUTE OUR ENDORSEMENT OR RECOMMENDATION OF SUCH PRODUCT OR SERVICE.
